Acceptance of Terms

By downloading, installing, or using Elevus, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

Description of Service

Elevus is a workout tracking application that allows you to log exercises, create routines, track progress with analytics, and use AI-powered features including natural language workout input, voice logging, and smart suggestions. The app offers both free and paid subscription tiers.

Not Medical Advice

Elevus is a fitness tracking tool and does not provide medical advice, diagnosis, or treatment. The AI features provide general fitness suggestions only and may not always be accurate. Always consult a qualified healthcare professional before starting any exercise program or making changes to your fitness routine. You use the app and follow any suggestions at your own risk.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when creating your account. You agree to notify us immediately of any unauthorized access to your account.

Subscriptions & Payments

Elevus offers the following subscription plans:

• • Free — Core workout logging, routines, analytics, and limited custom exercises
• • Premium Weekly — Access to AI features, unlimited custom exercises, and all premium functionality
• • Premium Annual — Same as weekly at a discounted rate

Subscriptions are billed through your Apple ID account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

To manage or cancel your subscription: go to iOS Settings → [Your Name] → Subscriptions. Your access to paid features continues until the end of the current billing period after cancellation.

Free trial periods, if offered, automatically convert to a paid subscription unless cancelled before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.

Refunds are handled by Apple in accordance with their refund policy. We may change subscription prices with advance notice. Price changes take effect at the start of your next billing period.

AI Features

Elevus uses third-party AI services to power features such as natural language workout parsing, voice input transcription, and smart set/rep suggestions. AI-generated content is provided for informational purposes only and may contain inaccuracies. You should verify any AI suggestions before acting on them.

We do not guarantee the availability, accuracy, or reliability of AI features. AI features require an active internet connection and a qualifying subscription.

User Content

You retain ownership of all workout data and content you create in Elevus. By using the app, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you. We do not sell your data or use it for advertising.

Acceptable Use

You agree not to:

• • Use the app for any unlawful purpose
• • Attempt to gain unauthorized access to our systems
• • Interfere with or disrupt the service
• • Reverse-engineer or decompile the app
• • Use automated systems to access the app in a manner that exceeds reasonable use
• • Abuse AI features (e.g., sending harmful, abusive, or excessively large inputs)

Intellectual Property

Elevus, including its design, features, and content (excluding user-generated content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute the app or its content without our permission.

Account Deletion

You may delete your account at any time through the app (Profile → Subscription → Delete Account). Upon deletion, all your personal data is permanently removed from our servers. If you have an active subscription, it will continue until you cancel it through Apple's subscription management. You can restore a previously purchased subscription by signing in again and using the "Restore Purchases" option.

Limitation of Liability

To the maximum extent permitted by law, Elevus and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to injuries sustained during exercise. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

The app is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Termination

We may suspend or terminate your access to the app at any time for violation of these terms or for any reason with reasonable notice. You may stop using the app and delete your account at any time. Upon termination, your right to use the app ceases, but these terms continue to apply to any prior use.

Apple End User License Agreement

This app is licensed, not sold, to you. Your use of Elevus is also subject to the terms of the Licensed Application End User License Agreement set forth by Apple (available at apple.com/legal/internet-services/itunes/dev/stdeula). In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall prevail with respect to your use of the app obtained through the Apple App Store.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes through the app. The "Last updated" date at the top of this page indicates when these terms were last revised. Continued use of the app after changes constitutes acceptance of the updated terms.
