Acceptance of Terms

By downloading, installing, or using Elevus, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the app.

Description of Service

Elevus is a training application. It allows you to log workouts, create routines, and track progress with analytics, and it offers:

• Training programmes — multi-week plans built around your goals, availability and the activities you already do
• AI Coach — a conversational coach that can answer questions and adjust your plan, profile and targets on your instruction
• Nutrition — calorie and macronutrient tracking, including barcode scanning and AI-assisted food logging
• AI body analysis — photo-based estimates of body composition and muscle development, tracked over time
• Apple Health — two-way sync of workouts and activity data
• AI-powered logging — natural language workout input and voice logging

The app offers both free and paid subscription tiers. We may add, change or remove features over time.

Not Medical Advice

Elevus is a fitness tracking tool and does not provide medical advice, diagnosis, or treatment. Nothing in the app — including training programmes, AI coach responses, recovery readiness, calorie and macronutrient targets, and body analysis results — is a medical opinion, and none of it is reviewed by a doctor, dietitian, or qualified trainer before you see it.

Always consult a qualified healthcare professional before starting any exercise programme, changing how you eat, or acting on anything the app suggests — and particularly if you are pregnant, have a medical condition, are recovering from injury, or have a history of disordered eating. You use the app and follow any suggestions at your own risk.

If you feel unwell or experience pain while training, stop and seek medical attention. The app cannot see you and cannot tell when something is wrong.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when creating your account. You agree to notify us immediately of any unauthorized access to your account.

Subscriptions & Payments

Elevus offers the following subscription plans:

• Free — Core workout logging, routines, analytics, and limited custom exercises
• Premium Weekly — Access to AI and premium features, including the AI coach, training programmes, nutrition tracking and body analysis
• Premium Annual — Same as weekly at a discounted rate

Which features sit in each tier, and any usage limits attached to them, may change as the app develops. We will not remove access you have already paid for within a billing period.

Subscriptions are billed through your Apple ID account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

To manage or cancel your subscription: go to iOS Settings → [Your Name] → Subscriptions. Your access to paid features continues until the end of the current billing period after cancellation.

Free trial periods, if offered, automatically convert to a paid subscription unless cancelled before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.

Refunds are handled by Apple in accordance with their refund policy. If you ask Apple for a refund, we may share information about how you've used the app with Apple to help it review your request. We may change subscription prices with advance notice. Price changes take effect at the start of your next billing period.

AI Features

Elevus uses third-party AI services to power features such as natural language workout parsing, voice transcription, the AI coach, training programme generation, nutrition parsing, and body analysis. AI-generated content is provided for informational purposes only and may contain inaccuracies. You should verify any AI suggestion before acting on it.

The AI coach can make changes on your behalf when you ask it to — for example editing your profile, adjusting a programme, or setting a target. You remain responsible for reviewing those changes; everything it can alter is also visible and editable by you in the app.

To keep the service available to everyone, AI features are subject to fair-use limits. We may adjust these limits, and we may suspend AI access for abuse.

We do not guarantee the availability, accuracy, or reliability of AI features. They require an active internet connection and, for most features, a qualifying subscription.

Body Analysis & Estimates

The body analysis feature produces ESTIMATES from photographs. Body fat percentages, muscle development scores, and any comparison between scans are approximations produced by an AI model, not measurements. They can be wrong, and they can be affected by lighting, posture, camera angle, and clothing. They are not a body composition scan and should not be treated as one, or used to make medical or dietary decisions.

Calorie and macronutrient figures are also estimates unless taken from a scanned barcode, and even those depend on crowd-sourced product data.

You must be 18 or over to use body analysis. Do not upload photographs of anyone else, or any photograph you do not have the right to use. If body analysis, weight tracking, or calorie targets affect your relationship with food or your body, stop using those features and speak to a healthcare professional.

Photos you take for analysis are stored on your device only. We cannot recover them if you delete the app, delete a scan, or lose your device.

Apple Health

If you connect Apple Health, Elevus reads activity and workout data to inform your training, and — with your permission — writes workouts back. We use Apple Health data only to provide features inside the app. We never use it for advertising or marketing and never sell it. Workouts you import from it are saved to your account so they stay in your history; everything else stays on your device. The AI coach is the other exception: it receives a summary of your recent activity with each message you send it, used only to produce that reply and not kept. Coach replies that mention your activity are saved with your conversation (see the Privacy Policy).

You can revoke access at any time in iOS Settings → Privacy & Security → Health. Data that Elevus has already written to Apple Health remains in the Health app until you remove it there.

User Content

You retain ownership of all workout data and content you create in Elevus. By using the app, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you. We do not sell your data or use it for advertising.

Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Reverse-engineer or decompile the app
• Use automated systems to access the app in a manner that exceeds reasonable use
• Abuse AI features (e.g., sending harmful, abusive, or excessively large inputs)

Intellectual Property

Elevus, including its design, features, and content (excluding user-generated content), is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute the app or its content without our permission.

Third-Party Data & Attribution

Barcode product information is provided by Open Food Facts (openfoodfacts.org) and is made available under the Open Database License (ODbL), and by the USDA's FoodData Central (fdc.nal.usda.gov), which is in the public domain. Elevus is not affiliated with Open Food Facts, and product data is crowd-sourced — we cannot guarantee its accuracy. Always check the packaging where it matters.

Nutrition figures for anything not scanned from a barcode are estimates.

Account Deletion

You may delete your account at any time through the app (Profile → Account & Data → Delete Account). Upon deletion, your account, your login, and all your personal data are permanently removed from our servers. If you have an active subscription, it will continue until you cancel it through Apple's subscription management. Your subscription belongs to your Apple ID, not your account, so you can restore it by creating a new account and using the "Restore Purchases" option.

Limitation of Liability

To the maximum extent permitted by law, Elevus and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to injuries sustained during exercise. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

The app is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Termination

We may suspend or terminate your access to the app at any time for violation of these terms or for any reason with reasonable notice. You may stop using the app and delete your account at any time. Upon termination, your right to use the app ceases, but these terms continue to apply to any prior use.

Apple End User License Agreement

This app is licensed, not sold, to you. Your use of Elevus is also subject to the terms of the Licensed Application End User License Agreement set forth by Apple (available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall prevail with respect to your use of the app obtained through the Apple App Store.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of significant changes through the app. The "Last updated" date at the top of this page indicates when these terms were last revised. Continued use of the app after changes constitutes acceptance of the updated terms.
